Terms of Service
Last updated Oct 19, 2026.
These terms
These terms are an agreement between you, and the account you sign up for, and WISEPLAN INC. (“we”). They cover the website, its free building check, its sign-up lists, the app and its paid plans (“the service”); the app is at app.towerbinder.com. By using the service you agree to them.
The free building check
The check finds a building with NYC Planning’s GeoSearch and reads public records about it from NYC Open Data: DOHMH’s cooling tower registrations and inspection results, and OATH’s summonses. It counts days from the last sample date DOHMH shows. We show these records as the City publishes them. They can be late, incomplete or wrong, and the agency’s own records decide. A date missing from DOHMH’s data does not prove a sample was not taken, and a date shown does not prove that the work around it was done.
Not legal advice, not the City
What the site says about the rules is a plain-English summary to help owners keep track of them. It is not legal advice and does not decide what applies to your building. The rules change; check the sources each rule page gives for your situation. TowerBinder is independent: it is not affiliated with or endorsed by DOHMH, the Department of Buildings, OATH, any other New York City agency or the State of New York.
The sign-up lists
Asking us to watch a building, or joining early access, is free and commits you to nothing. We email you when something changes for the building you watch, and about your early access when it is ready. Each alert email stops with one click; leave either list at any time by writing to us.
Free monitoring
The app is free. It reads DOHMH’s and OATH’s public files once a day for the buildings your account adds and emails the people who turned the alert email on. We send the emails as best we can; an email can be late, land in spam or not arrive, and the City’s records can be late or wrong. The duties of Admin Code §17-194.1 and 24 RCNY Chapter 8 stay with the building’s owner, whatever the app shows or sends. Owners of an account decide who is on its team and answer for what the people they invite do in it. We may end the free service, telling the people on accounts by email at least 30 days before.
The records
The records (readings, checklists, samples and their results, inspections, cleanings, treatments, filings) come with a paid plan, below. They are free for early-access accounts until the end day we set for early access, and we email the owners of an account at least 30 days before any charge; nothing is charged unless an owner chooses a plan and accepts its terms.
Records are kept as written: each is signed with the person who saved it and the time, and a correction is a new record with its reason, the original kept. The deadlines the app shows come from the rules as we read them, with our assumptions labelled where a rule leaves a choice; the app knows only what the records and the City’s files show. Whoever saves a record answers for what it says, and the duties of Admin Code §17-194.1 and 24 RCNY Chapter 8 stay with the building’s owner.
Inspection mode shows the records on file, as they were written, with the documents attached to them; it shows what an account has kept, not whether a system meets the rules. The binder PDF and the filing documents (the hyperhalogenation declaration worksheet, the annual certification package, the statement of non-operation, the startup record) are worksheets prepared from the records: they are not forms of DOHMH or DOB, and the owner checks, signs and files them where the rules say.
Your records
The records and files an account keeps are its own. You give us the right to store them, process them and show them to the people on your account, only to run the service; we do not sell them or use them for anything else. Whoever is on the account can export them at any time: the binder PDF with its documents, and the systems as CSV, with or without a paid plan. If we end the app or its paid plans, we email the owners of every account at least 90 days before, and the export stays open until then. You answer for the records your account saves and for how its people use the service, and you cover our reasonable costs if someone else makes a claim against us because of them.
Paid plans
Monitoring stays free. The records, with inspection mode, the binder and the filing documents made from them, come with a paid plan: Building, for one building, at $79 a system a month or $790 a year, each further system in the same building $39 a month ($390 a year); or Portfolio, for every building on an account, at $49 a system a month, billed yearly, from 10 systems (an account with fewer pays for 10). A building with more than 4 systems is priced by writing to us. Prices are in US dollars; sales tax is added where it applies.
Stripe is the merchant of record: through its Managed Payments service it sells the plan, charges the card and handles sales tax, receipts, invoices and refunds under its own terms, shown at its checkout; the receipts and invoices come from Link, Stripe’s payment service. Only an owner of an account chooses a plan, after accepting these terms. A plan renews automatically at the end of each month or year, at its price, and is charged to the card on file until it is cancelled. An owner can cancel it online at any time in the billing portal (Settings, Plan and billing) or in Link; a cancellation before the renewal date stops the next charge. A cancelled plan runs to the end of the period paid, and the rest of that period is not refunded, except after a price change, below. When the number of systems DOHMH’s registry shows for a building changes, its plan moves to the price for that number from the next renewal; Portfolio follows the account’s systems from its next renewal in the same way. Choosing Portfolio cancels the account’s building plans, which run to the end of the period paid.
Without an open plan (none chosen, cancelled and ended, paused or unpaid) the records stay on the account, read only: they can be opened, shown in inspection mode and exported, but nothing can be added to them. Early-access accounts keep the records free until the end day we set, and we email their owners at least 30 days before any charge. We may change the prices. A new price applies to a plan only from a renewal: we email its owners between 5 and 30 days before that renewal, and an owner who cancels within 14 days after the first charge at the new price gets back the unused part of that charge.
Acceptable use
Use the check and the app for buildings you own, manage, service or are considering. Do not use them for anything unlawful, to get around their limits or security, or to collect their results in bulk; each visitor gets 30 checks a day and an account monitors up to 500 buildings. Automated access needs our written agreement.
Disclaimers
The service is provided as it is and as available, the free parts free of charge. To the extent the law allows, we make no promises about it beyond these terms, including that the City’s records it shows are accurate, complete or current, that an alert or a reminder arrives, that the deadlines it shows are every deadline a rule sets for your building, or that the service is never interrupted.
Liability
To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data arising from the service, and our total liability for all claims about the service is limited to the amounts you paid us for the service in the 12 months before the claim, or $100 if you paid nothing. Fines or penalties an agency imposes for the work or the records a rule asks of an owner remain the owner’s. Nothing here limits a liability the law does not allow to be limited.
Governing law
These terms are governed by the laws of the State of New York. Disputes go to the state and federal courts in New York County, New York.
Changes to these terms
We may update these terms as the site changes; the date at the top shows which version this is. We email the people on our lists about a material change before it applies.
